THRILLZZ Football Pick’em Challenge Terms

NO PURCHASE NECESSARY TO PARTICIPATE IN THIS PROMOTION. NO PURCHASE WILL INCREASE YOUR CHANCES OF WINNING. THIS PROMOTION IS INTENDED FOR ENTERTAINMENT PURPOSES ONLY AND IS VOID WHERE PROHIBITED BY LAW. SECTION 6.8 OF THESE PROMOTION TERMS INCLUDES A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER. PLEASE REVIEW THAT SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.
The following are the terms and conditions (the “Promotion Terms“) of the “THRILLZZ Football Pick’em Challenge” (the “Promotion“) which is sponsored by Thrillzz Inc. (“Sponsor“, “us” or “we” or “our“). By participating in the Promotion, you agree to be bound by these Promotion Terms, which constitute a binding agreement between you and Sponsor. All collection and processing of personal information as part of or in connection with participating in the Promotion is subject to and governed by our Promotion Privacy Notice available at https://thrillzz.com/privacy-policy/ (“Privacy Policy“).
By participating in the Promotion, you hereby represent and warrant that you have read, understood and agree to be bound by these Promotion Terms and any and all other terms and conditions relating to the Promotion. In the event you do not agree to be bound by the Promotion Terms, or any amendment thereto, you must not participate or otherwise take part in the Promotion or withdraw and discontinue your participation in the Promotion.
1. General
1.1 The Promotion is an ongoing promotion conducted as a series of separate weekly contests, each covering the NFL games scheduled in such week (each, a “Weekly Contest“). Each Weekly Contest shall commence, and all entries in respect of that Weekly Contest must be received, by the entry deadline published on the Promotion Page for that Weekly Contest (which shall in all cases be prior to the kick-off of the first game included in that Weekly Contest), and shall conclude upon completion of the final game included in that Weekly Contest. The Promotion shall commence on the date published on the Promotion Page and shall consist of not fewer than two (2) consecutive Weekly Contests. Sponsor may, in its sole discretion, conduct additional Weekly Contests during the 2026-27 NFL season, but shall be under no obligation to do so. All dates, times, games and entry deadline applicable to the Promotion and to each Weekly Contest will be as published on the Promotion Page from time to time. The Promotion will conclude upon completion of the last Weekly Contest announced by Sponsor on the Promotion Page (the “Promotion Period“). Any late or incomplete entries will not be accepted. The Sponsor’s computer shall be the official timekeeping device for this Promotion.
1.2 You agree that in order to participate in the Promotion (including, without limitation, in order to win any reward), you will fully comply with all applicable laws, regulations, statutes, ordinances and provisions that apply to you and to us, including, without limitation, the Promotion Terms.
1.3 There is no cost to enter the Promotion or any obligation associated with participating in it, except as described below. There shall be no limitation on the number of participants eligible to participate in the Promotion.
2. Eligibility
2.1 In order to participate in the Promotion you must: (i) be a natural person who is a legal resident of the United States and located in the United States; (ii) be at least nineteen (19) years old as of the date of entry (or the applicable age of majority in your jurisdiction, if higher) (iii) be able to form legally binding contracts under applicable law; (iv) not be physically located in any of the following states: Alabama, Arizona, California, Connecticut, Georgia, Hawaii, Idaho, Indiana, Kentucky, Louisiana, Maine, Michigan, Mississippi, Montana, Nevada, New Jersey, New York, Ohio, Tennessee and Washington (collectively, “Restricted States“) when registering for, accessing, or participating in the promotion, including without limitation engaging in any activity related to the Promotion; (v) be eligible under applicable law to participate in the Promotion, (vi) not be an employee or immediate family member of an employee of Sponsor or its affiliates, or any person or entity involved in the administration of the Promotion. This Promotion is void in the Restricted States and where otherwise prohibited by law.
2.2 Limit one (1) entry per person per Weekly Contest. You may not use multiple email addresses, accounts or identities or any other method in order to participate in any Weekly Contest more than once. Any attempt to circumvent this limitation or otherwise gain an unfair advantage will result in the disqualification of all relevant entries.
2.3 Entries generated by script, macro, bot or other automated means will be disqualified.
2.4 You may not register on behalf of another person.
2.5 You may be asked at any time to provide us or our designated third party with proof of your age and/or identity and/or residency and you must, on demand, be able to present a valid documentation which may enable us to verify your age, residency and/or identity to the reasonable satisfaction of our team.
2.6 Sponsor’s employees (including, without limitation, part-time or temporary employees), officers, and representatives, promotion agencies and/or sponsors directly involved in the administration, development, fulfilment, and execution of the Promotion, and the immediate family and other household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners, and siblings) of any of the above are not eligible to enter and/or to win the Promotion.
2.7 National Football League athletes, coaches, team management, team support personnel (including without limitation team physicians), team owners, referees, league employees, commissioners, and other individuals who through an ownership interest or game-related employment could influence gameplay are not eligible to enter or participate in this Promotion. Thrillzz is not affiliated with or sponsored by any of the above.
2.8 If you are unable to comply with these Promotion Terms, including by providing satisfactory documents, we may, at our sole reasonable discretion and at any time (both during the Promotion Period or afterwards, as applicable), exclude you from the Promotion and you may be required to forfeit any privileges or awards that have been allocated to you without compensation of any kind. You hereby irrevocably waive any claims or rights in connection with any such exclusion and/or forfeiture.
3. How to Enter and Win
3.1 Each Weekly Contest consists of placing entries on the results of the NFL games included in that Weekly Contest by selecting: (i) the winning team for each such game; and (ii) the winning team’s margin of victory (spread) for each such game. Points will be awarded as follows: (a) ten (10) points for correctly placed pick on the winning team; (b) seven (7) additional points where the predicted margin of victory is within two (2) points of the actual margin of victory; and (c) fifteen (15) points (in lieu of the points under (b)) for correctly picking the exact margin of victory. Participants will accumulate points across all games included in the applicable Weekly Contest. The determination of participants’ correct picks shall take place upon the conclusion of each applicable game. The participants who accumulated the highest number of points at the conclusion of all games included in a Weekly Contest shall, subject to verification, be declared the winners of that Weekly Contest and shall be eligible to win the Prizes (as defined below).
3.2 In the event that two or more participants have accumulated the same number of points at the conclusion of all games included in a Weekly Contest, the tie shall be broken as follows: (a) first tie-breaker: the participant who submitted their picks earliest (based on Sponsor’s server timestamp) shall be ranked higher; and (b) final tie-breaker: if a tie still remains after applying the foregoing tie-breaker, the tied participants shall equally share in the applicable Prize position(s) and the Prize(s) associated with such position(s) shall be divided equally among them (or, if the Prize is not divisible, a prize of equal value shall be awarded to each tied participant, at Sponsor’s sole discretion).
3.3 The odds of winning are based on the number of eligible entries received and the accuracy of each participant’s predictions.
3.4 A leaderboard displaying participant rankings and accumulated points will be available on the Promotion Page. The leaderboard will be updated following the conclusion of each game included in the applicable Weekly Contest. Leaderboard position is for information purposes only and does not guarantee prize eligibility, which remains subject to verification of the participant’s eligibility, picks, and compliance with these Promotion Terms.
3.5 You may apply to participate in the Promotion by visiting the Promotion page at: https://thrillzz.com/football-pickem/ (the “Promotion Page“) and completing the registration process by: (i) entering a valid email address; (ii) receiving a verification code via email; (iii) entering the verification code on the Promotion Page to activate your entry; and (iv) checking the confirmation box confirming that you are at least nineteen (19) years old (or the applicable age of majority in your jurisdiction, if higher) and that you have read and agreed to these Promotion Terms. Once verified, you may submit your predictions for all games included in the applicable Weekly Contest. Registration for this Promotion does not create a Thrillzz account.
3.6 You must provide, at your own expense, the equipment, software, subscriptions, Internet connections or devices and/or service plans as may be required to access and/or participate in Promotion. Thrillzz does not guarantee that the Promotion or all portion(s) thereof can be accessed on all devices. Thrillzz does not guarantee that the Promotion is available in all geographic locations. You acknowledge that by participating in the Promotion, your Internet provider or service provider may charge you fees for access, data, and/or other contents, products, or services. Check with your applicable provider(s) to see if there are any such fees that apply to you.
3.7 All predictions in respect of a Weekly Contest must be submitted no later than the entry deadline published on the Promotion Page for that Weekly Contest, which shall be prior to the kick-off of the first game included in that Weekly Contest, in order to be eligible. Late or incomplete entries will not be accepted.
3.8 Any requests for participation that do not comply with these Promotion Terms may be disqualified or void at our sole reasonable discretion. No other form or method for submitting an entry will be accepted.
3.9 THE DECISIONS OF SPONSOR ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION AND THE AWARDING OF PRIZES. A PARTICIPANT SHALL NOT BE ELIGIBLE TO RECEIVE A PRIZE, EVEN IF THE PROMOTION PAGE INDICATES THEY HAVE WON, UNLESS AND UNTIL THE PARTICIPANT’S ELIGIBILITY, PREDICTIONS AND ACCUMULATED POINTS HAVE BEEN VERIFIED BY SPONSOR. SPONSOR WILL NOT ACCEPT SCREENSHOTS OR OTHER PURPORTED EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION AND VERIFICATION PROCESS.
3.10 Entries received from ineligible entrants or that do not comply with these Promotion Terms will be considered void. Entries that are determined to be fraudulent will be considered void, and the person making such entry may be barred from participation in the Promotion and, in Sponsor’s sole discretion on a case-by-case basis, disqualified from any future participation in any future Sponsor’s promotions and/or services. Proof of sending or submission does not constitute proof of receipt. You hereby agree that in no event will you have any claims against us for any submissions that were not received or acknowledged by us, for any reason whatsoever.
3.11 Sponsor reserves the right at its sole discretion, and at any time, to disqualify any individual who is found to be, or whom Sponsor reasonably suspects to be: (i) acting in violation of the Promotion Terms, (ii) acting in an unsportsmanlike or disruptive manner, with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, (iii) tampering with the entry process or attempting to tamper with the entry process, the operation of the Promotion Page, the Promotion Page, or any related systems, or (iv) otherwise engaging in any fraudulent, abusive, deceptive, unlawful, or other improper conduct in connection with the Promotion. Without limiting the foregoing, in the event the Sponsor is prevented from continuing with the Promotion as contemplated, or the integrity fairness, security or proper administration of the Promotion is compromised or otherwise affected, due to any event beyond Sponsor’s reasonable control or due to any technical or operational issue(s) (including, without limitation, computer, hardware, software, network, server, or telecommunications malfunctions, bugs errors, defects, viruses, interruptions, unauthorized access or any other failure or delay in the operation or transmission of the Promotion), a force majeure event, fire, flood, epidemic or other national health emergency, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared,) or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, public health crisis, then Sponsor shall have the right, in its sole discretion, to void any affected entries and/or to modify, suspend, extend, cancel or terminate the Promotion.
3.12 Without limiting the foregoing, the Sponsor may disqualify and lock out any participant who, in Sponsor’s sole judgment, has questionable eligibility or is otherwise ineligible to participate in the Promotion. Any person who attempts to undermine or interfere with the legitimate operation of the Promotion may be subject to civil and/or criminal liability, and Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
3.13 Use of robotic, mechanical, automated, or other forms of pre-programmed entry methods is strictly prohibited and will result in disqualification.
3.14 Unless otherwise specifically allowed with respect to the Promotion, you may not use multiple email addresses, accounts or identities or any other method in order to participate in the Promotion. Any use of automated system or any similar method to participate in the Promotion is strictly prohibited and may result in your disqualification from the Promotion. The person to whom the email address was assigned by the applicable operator shall be deemed as the owner of such email address.
3.15 Sponsor reserves the right to modify, alter, or change the Promotion Terms, and the Prizes amounts at any time in its sole discretion. Any changes will be posted on the Promotion Page. You acknowledge that you shall be responsible for staying up to date with any and all changes made to the Promotion. Your continued participation in the Promotion constitutes acceptance of the modified Promotion Terms.
3.16 Sponsor reserves the right (but is not obligated to) in its sole discretion, from time to time, to implement detection and enforcement measures to prevent and disqualify non-compliant entries. You hereby irrevocably waive any claims against the Sponsor in connection with any such enforcement or similar action taken by the Sponsor.
4. Prizes
4.1 The prizes to be awarded in respect of each Weekly Contest shall be as follows: (i) the first-place winner shall receive one (1) 75″ Smart TV; (ii) the second-place winner shall receive an NFL Shop Gift Card worth $500; and (iii) the third-place winner shall receive a Sony PlayStation 5 Console (each, a “Prize”, and collectively, the “Prizes”).
4.2 In addition to the Prizes, the fifty (50) highest ranked participants in each Weekly Contest (those participants who accumulated the highest number of points, as determined and verified in accordance with Section 3) shall be eligible to receive a reward consisting of a coins package with a retail value of five U.S. dollars ($5) and comprised of five thousand five hundred (5,500) Coins and five (5) free Thrillzz Sweeps (“Free Sweeps“) (together the “Coins Package Reward“). Notwithstanding Section 3.5, each eligible participant’s receipt, redemption and use of the Coins Package Reward (including any Coins and Free Sweeps) shall be conditioned upon such participant downloading the Thrillzz branded application and completing the registration of a Thrillzz account. The Coins Package Reward must be claimed and redeemed within seven (7) days following the announcement of the winners of the applicable Weekly Contest (as described in Section 4.3 below), after which time the Coins Package Reward will expire and be forfeited without compensation of any kind. Use of the Thrillzz branded application which includes, without limitation, the receipt and use of Thrillzz Sweeps, Thrillzz Picks and Prize Tickets shall be governed by the terms and conditions of the Thrillzz branded application, including, without limitation, the Promotional Terms of Use, Sweepstakes Official Rules, Promotional Prediction Rules, Pick’em Tournament Official Rules and Mini Games Sweepstakes Official Rules. The Coins Package Reward is non-transferable, and may only be redeemed subject to and in accordance with the terms of this Section 4.2 and the applicable Thrillzz terms referenced herein.
4.3 Winners will be publicly announced on the Promotion Page within seven (7) days from the end of the applicable Weekly Contest. By participating in the Promotion, the winners allow the Sponsor to publicly disclose their information, including without limitation, email address, username, and state of residence, solely for the purpose of announcing them as such.
4.4 Prizes are limited to the items specified in Section 4.1 above and are non-transferable and cannot be redeemed for a cash equivalent. If the Prizes, or any portion thereof, cannot be granted for any reason, we reserve the right (but not the obligation) to substitute such Prizes for prizes of equal or greater value.
4.5 The winners are solely responsible for reporting and paying any and all applicable taxes related to the Prizes and paying any expenses associated therewith which are not specifically provided for in the Promotion Terms. Thrillzz does not provide tax advice, nor should any statements in this Promotion Terms be construed as tax advice.
4.6 By participating in the Promotion, you allow the Sponsor to contact you, for the purpose of administration of the Promotion and awarding of the Prize. We will notify each potential winner by sending a notification through the email address (which was used to register), within seven (7) days from the end of the applicable Weekly Contest.
4.7 Except where legally prohibited, the potential Prize winners may be required to sign and return, an affidavit or declaration of eligibility, liability and publicity release (“Affidavit”) in order to claim the Prizes.
4.8 We will make a maximum of three (3) attempts to contact the potential winners within seventy-two (72) hours.
4.9 If we are unable to contact the potential winner within the above-specified time frame, or if such potential winner fails to sign and return the Affidavit, or is otherwise disqualified, or does not comply with the Promotion Terms, Sponsor may revoke a participant’s right to any Prize and grant it to another winner.
4.10 It is your sole responsibility to notify us in writing if you changed your contact details during the Promotion Period or the applicable Weekly Contest.
4.11 Prizes will be delivered to winners within forty five (45) days from the date on which the winner is confirmed by Sponsor, following completion of all applicable verification steps, return of any required Affidavit, and any other eligibility checks required under these Promotion Terms end of the Promotion Period.
4.12 As Sponsor is not the manufacturer of the Prizes, Sponsor makes no warranty or representation, whether express or implied (whether by law, statute, or otherwise), with respect to the Prizes, including, but not limited to, implied warranties and conditions of merchantability, satisfactory quality, condition, or fitness for a particular purpose. In addition, Sponsor makes no warranty that any electronic Prize will be uninterrupted, timely, secure, or error-free, or that it is free of viruses, bugs, or defects. All Prizes are offered ‘as is’ and ‘as available.’ Sponsor shall have no obligation to repair, replace or refund any Prize that is lost, damaged, or defective following delivery. The winners of Prizes hereby agree to release Sponsor and its affiliates, officers, directors, employees, and agents, from any and all claims arising from or relating to the Prizes.
4.13 Sponsor reserves the right to use the Promotional Partner or a third-party vendor to deliver the Prizes to winners. Sponsor shall not be liable for any late delivery of Prizes. Prizes may be delivered in physical or electronic form, as applicable. Any physical Prize will be at the risk of the winners from the time they leave the supplier’s or deliverer’s premises and ownership of the Prizes will pass to the winner(s) upon delivery. Any electronic Prize (including any gift card delivered electronically by email, code or otherwise) will be deemed delivered, and risk and ownership shall pass to the winner, upon transmission to the email address or account associated with the winner’s entry.
4.14 If any potential winner is required by any applicable law or the Promotion Terms to comply with additional conditions or requirements in order to participate in the Promotion and/or to receive the Prizes, such potential winner must fully comply with such requirements within the time set by us and /or applicable laws as a condition to receiving the Prizes.
4.15 If a potential winner is disqualified for any reason, we may award the Prize to an alternate winner from among the remaining eligible participants, in our sole discretion.
4.16 To obtain the first name, last initial, city and state of the winners, send a self-addressed, stamped envelope marked “Thrillzz NFL Pick’em Challenge Winners List” to us (contact details are available below). Requests for a winners list must be received no later than 90 days from the end of the applicable Weekly Contest. Residents of Vermont need not include return postage.
5. Limitations of liability; waiver and release
5.1 By entering into the Promotion, you agree to release, indemnify, and hold harmless the Sponsor, and its respective parents, subsidiaries, affiliates, distributors, suppliers, and advertising, promotional and judging organizations and each of their respective employees, officers, directors, shareholders, and agents (collectively, the “Indemnitees”) from and against any and all claims, actions, damages, losses, liabilities, costs, expenses (including court and reasonable attorney fees, as applicable), injuries of any kind that in any way now or hereinafter may arise from or relate to the Promotion, including without limitation: (i) the administration of, and your participation in, the Promotion including but not limited to any typographical, printing, human or other errors relating to or in connection with the Promotion, the processing of entries (including of other participants), the announcement of the Prizes or any related materials, inaccurate, fraudulent, incomplete, illegible, late, lost, stolen, misdirected, undelivered, incomplete, or damaged entries, any delays in delivery or lack of availability of the Prizes or any other related materials; (ii) death or bodily injury (including emotional distress), due in whole or in part, directly or indirectly, to the administration and participation in the Promotion or any Promotion-related activity, and (iii) any claims or other causes of action based on a breach of any third party or person’s rights including but not limited to intellectual property, publicity or privacy rights.
5.2 You agree that the Indemnitees are not responsible for any incorrect or inaccurate information, whether caused by other participants, or by any of the equipment or programming associated with or utilized in connection to the Promotion and that the Indemnitees assume no responsibility for: (i) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from a user’s participation in the Promotion or receipt or use or misuse of the Prizes; (ii) any error, omission, interruption, deletion, defect, or delay in operation or transmission of the Promotion; (iii) any computer, telephone, cable, satellite, network, electronic or internet hardware or software malfunctions or failures, problems with connections, their availability, accessibility or availability, and (iv) unauthorized human intervention, theft or destruction, tampering, or unauthorized access to entries and/or entry information. In case of any of the foregoing, the Indemnitees reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the Promotion and select the winner from among all eligible entries received for the Promotion prior to the action taken.
5.3 IN NO EVENT WILL THE INDEMNITEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OTHER THAN YOUR ACTUAL OUT-OF-POCKET EXPENSES ARISING OUT OF YOUR PARTICIPATION IN THE PROMOTION OR THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE. WITHOUT LIMITING THE FOREGOING, THE PROMOTION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
6. Additional General Terms
6.1 Sponsor may cancel, modify or suspend the Promotion, the Prizes or any other benefit offered hereunder, including without limitation, where required for security reasons, to comply with applicable law or regulation, for example, due to abuse or otherwise where due to circumstances beyond its control (e.g., epidemic, earthquake, strike, war, act of God etc.) the Promotion is not capable of being conducted as specified.
6.2 If we become aware of any fraud, deceit, misconduct, dishonesty or similar action concerning your participation in the Promotion, or if you acted in a disruptive manner or with the intent to disrupt or undermine the legitimate operation of the Promotion or if you breached any of these Promotion Terms and/or any additional laws, regulations and rules which apply to your participation in the Promotion, then we reserve the right (but are not obligated) in our sole discretion to disqualify or invalidate your entry, without limitation to any right available to us under applicable law, these Terms or any contract, to seek damages and other remedies from you to the fullest extent permitted by law. Without derogation from the forgoing, if fraud, deceit, misconduct, dishonesty or other non-compliant action is only discovered after a Prize has been granted to you, then you shall be required, upon demand, to return the Prize (or provide equivalent compensation) to us immediately upon receipt of our demand to do so.
6.3 You hereby acknowledge and agree that as a condition to your participation and winning of any Prize, we may be legally required to publish certain information concerning you (for example, in connection with the winners list described in Section 4.15 or as otherwise required by applicable law).
6.4 By participating in the Promotion, you acknowledge that the Sponsor may collect and use your name, username, email address, state of residence, participation details, predictions, and accumulated points for the purposes described in the Privacy Policy, including administration of the Promotion, winner verification, prize fulfillment, public announcement of winners (as described in Section 4.2), display of leaderboard rankings, and marketing communications (subject to your right to opt out as described in the Privacy Policy). You further acknowledge and agree that Sponsor may disclose your name and delivery details to its fulfillment partners (including the Promotional Partner) as reasonably required to procure and deliver the Prizes to you. In addition, in connection with winner verification, Sponsor’s designated third-party verification provider may collect, process and retain identification documents, verification records and such other personal information as may be required by such provider to complete the verification process. Such information may be retained by the third-party verification provider in accordance with its own retention policies and applicable legal and regulatory requirements, and Sponsor does not commit to the deletion or anonymization of such records.
6.5 To the extent that winner announcements or leaderboard displays incorporate your name or other identifiable information, you grant Sponsor a non-exclusive, royalty-free right and license to use such information for those limited purposes for the duration of the Promotion and a reasonable period thereafter. For the avoidance of doubt, the collection, use, and disclosure of your personal information in connection with the Promotion is governed by the Privacy Policy.
6.6 By participating in the Promotion, you acknowledge that Sponsor may use the email address you provide at registration to send you marketing and promotional communications about Thrillzz and its services, including information about the Thrillzz mobile application. You may opt out of receiving such communications at any time by following the unsubscribe link included in any marketing email or by contacting us at support@thrillzz.com. Opting out of marketing communications will not affect your participation in, or eligibility for, the Promotion.
6.7 Sponsor will retain personal information collected in connection with the Promotion only for as long as reasonably necessary to fulfill the purposes described in these Promotion Terms and the Privacy Policy, including administration of the Promotion, prize fulfillment, compliance with legal obligations (such as tax reporting requirements), and resolution of any disputes. Notwithstanding the foregoing, Sponsor may retain participant email addresses for the purpose of sending marketing and promotional communications as described in Section 6.6, for so long as the participant has not opted out of such communications. Upon opt-out, Sponsor will cease marketing communications and will delete the participant’s email address within a reasonable period, except to the extent retention is necessary for compliance, dispute resolution, or to maintain a suppression list to honor the opt-out request.
6.8 Third party terms and conditions apply to the Prizes, where applicable. The Sponsor is not responsible or liable for the acts or omissions of any such third parties, and any claims or issues relating to third-party Prizes must be directed to the applicable third party.
6.9 This Promotion is not endorsed by, affiliated, or associated with, maintained, or sponsored by the National Football League (“NFL”), any NFL team, or any other third party, except Sponsor. All products, services and company names referenced and/or included are the registered trademarks of their original owners. The use of any mark, name, image, or likeness is for identification and reference purposes only and does not imply any association with the trademark holder, respective individual, or their brand. The Sponsor expressly disclaims any affiliation with any third-party trademarks or rights of publicity referenced and/or included on the Promotion, or related materials. The use of any mark, name, image, or likeness is not intended to mislead, confuse, or infringe on the copyright, rights of publicity, privacy or trademark of any third party. Such use in no way indicates any relationship with any third party, nor does it signify that any such third party is the source of, endorses, approves of, or sponsors the Promotion. We make no commercial claim to the use of any copyright, rights of publicity, or trademark of any third party, or suggestion of sponsorship or endorsement, and any such use is provided for informational purposes only.
6.10 Sponsor shall be the sole arbiter in all matters relating to the Promotion and the interpretation of these Promotion Terms. The decisions of the Sponsor will be final and binding as to all matters, including, without limitation, whether any entry submitted is valid or not. Entry into the Promotion constitutes agreement by entrants to abide by these Promotion Terms, as well as any other rules established by the Sponsor.
6.11 As a condition of participating in the Promotion, you agree that any and all disputes, claims and causes of action arising out of or in connection with this Promotion shall be resolved individually, without resort to any form of class action, exclusively by mandatory, binding arbitration by JAMS ADR under its then current applicable rules. You and Sponsor each waive any right to participate in any class, collective, consolidated or representative proceeding and unless both you and Sponsor agree, no arbitrator or judge may consolidate more than one person’s claim or otherwise preside over any such class, collective, consolidated or representative proceeding. This waiver is independent of, and shall survive, any determination that the agreement to arbitrate is unenforceable.
You further agree that under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim any damages whatsoever including, without limitation, punitive, consequential, direct or indirect, or any other damages. We reserve the right to modify prize award procedures. All issues and questions concerning the validity, construction, interpretation, performance, and enforcement of the Promotion and these Promotion Terms, or Sponsor’s or your rights and obligations, shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
6.12 If any portion of these Promotion Terms is found to be unenforceable or unlawful for any reason, including because it is found to be unconscionable: (i) the unenforceable or unlawful provision will be severed from these Promotion Terms; (ii) severance of the unenforceable or unlawful provision will have no impact whatsoever on the remainder of these Promotion Terms, and (iii) the unenforceable or unlawful provision may be revised to the extent required to render these Promotion Terms enforceable or valid, and the rights and responsibilities of the parties will be interpreted and enforced accordingly, so as to preserve these Promotion Terms and the intent of these Promotion Terms to the fullest extent possible.
6.13 The Promotion may be advertised on various social media platforms and other media outlets, such as Facebook, Instagram, X (“Twitter”) or any other social media site (collectively “Social Media Site(s)”). These Social Media Sites are not sponsors, endorsers, or affiliated in any way with the Promotion.
This Promotion is being promoted by Literally Media Ltd. (“Promotional Partner”) through its social media channels. Promotional Partner is not a sponsor of this Promotion and is not responsible for its administration or operation. Promotional Partner may, acting solely as agent for and on behalf of Sponsor and using funds provided by Sponsor, procure and/or deliver certain Prizes to winners. In performing such fulfillment activities, Promotional Partner acts under Sponsor’s direction and Sponsor remains responsible for the Promotion as the Sponsor. Except to the extent reasonably necessary for Promotional Partner to perform prize procurement and delivery on Sponsor’s behalf, Promotional Partner does not collect or have access to participant registration data. All personal information collected through the Promotion Page is collected and controlled by Sponsor in accordance with the Privacy Policy, and any winner information shared with Promotional Partner for prize fulfillment shall be limited to that reasonably required for such purpose.
